On January 10, 2025, Treasury and IRS issued a notice of intent to propose rules on the 45Z Clean Fuel Production Credit, along with the table of carbon intensity scores and credit calculations. On January 30, 2025, the IRS published the 45Z Clean Fuel Production Credit notices 2025-10 and 2025-11 in the Internal Revenue Bulletin. Treasury is requesting comments on the notices by April 10. Comments can be submitted via Regulations.gov.
On January 15, 2025, the USDA published an Interim Rule on Technical Guidelines for Climate-Smart Agriculture Crops Used as Biofuel Feedstocks. The rule includes a beta version calculator of carbon reductions associated with a short list of practices for corn, soy and sorghum. USDA is soliciting comments on the rule and calculator through March 18, 2025.
